Ajay Kumar Gupta has submitted authentic proof i.e. his passport to the Speaker of Parliament, Baleka Mbete, proving his absence in South Africa against the accusations raised on him by Eskom’s suspended legal head, Suzanne Daniels, of his meeting with her on July 29, 2017.
Suzanne Daniels has accused Ajay Gupta, Zuma’s son Duduzane, Deputy Public Enterprises Minister, Ben Martins and Salim Essa, a close friend of the Guptas, of their meeting with her in Johannesburg to discuss the former Eskom CEO, Brian Molefe’s R30-million pension payout court case.
In pursuit of all this, Ajay Gupta along with Ben Martins have submitted authentic proofs of their engagements elsewhere on the alleged date mentioned by Daniels. The Gupta’s lawyer, Mthuthuzeli Vanara is to institute criminal charges against Daniels and as per the South African laws anyone making false allegations in the Parliament has to undergone two years of rigorous imprisonment, once the charges are proved against the offender.

Mr. Gupta in a brief letter written to the Speaker of Parliament, proved that Ms. Daniel is alleged levying charges of state capture against him. Explaining further he said that Ms. Daniels has falsely claimed that he attended a tea party in Johannesburg with her. He provided his passport to the speaker of the Parliament which subjectively authenticates his statement. Eskom’s suspended legal head Suzanne Daniels has claimed this in an evidence before the Public Enterprises Portfolio Committee probe into Eskom. Mr. Gupta has also copied the letter sent to Mbete to the Hawks.
Mthuthuzeli Vanara, lawyer of the Gupta’s was quoted on his statement against Daniels saying, “we act on behalf of Mr Ajay Gupta in his personal capacity. In her testimony, she made a number of very serious claims and allegations involving my client”. Vanara is to institute criminal charges against Daniels.

Ben Martins Falsifies Daniels Allegations
Deputy Public Enterprises Minister, Ben Martins provided proofs that he was not at the alleged meeting as claimed by Daniels. Martins has provided proofs that he was at the funeral of Cyril Ramaphosa’s spokesperson, Ronnie Mamoepa on the day of the claimed meeting and later at an ANC event. He was quoted by the media saying, “I am perplexed by Ms Suzanne Daniels’ testimony to the parliamentary inquiry into Eskom.”
He went on to say, “She falsely claimed that I had attended a tea party in Johannesburg with her, Mr Ajay Gupta, Mr Salim Essa and Mr Duduzane Zuma”.
“The truth is that I met Ms Daniels several times in her capacity as Eskom Company Secretary, together with the then Chairperson of Eskom Dr Ben Ngubane, Department of Public Enterprises Director-General Richard Seleke, Minister Lynne Brown in Cape Town and Tshwane to discuss the Brian Molefe matter”, said Martins.
Martin explained further to the media saying, “I admit to admonishing Ms. Daniels for the governance lapses that had taken place under her watch as the Company Secretary and Legal Advisor at Eskom, during the meetings we had with the Minister of Public Enterprises and Dr Ngubane. My collegial constructive criticism was never meant as a personal attack. As the head of Eskom’s legal department, Ms Daniels should account to Parliament for what happened under her watch rather than seek to use the occasion to reinvent herself as clueless ignoramus.”

Eskom suspended legal head Suzanne Daniels bluffed the Parliament in order to defend herself of her alleged involvement in Eskom by lying that she met Ajay Gupta, Duduzane Zuma, Ben Martins and Salim Essa, a close friend of Gupta’s and an unknown Chinese woman in Johannesburg to discuss the former Eskom CEO Brian Molefe’s pension payout court case. As per the sources, Daniels did so in order to divert the attention of the multi-party committee, which is investigating state capture at Eskom and the proceeding in this pretext would take place on November 22, 2017, alleging her involvement in team-building exercise at Eskom, destroying crucial documents and not adhering to instructions to respond to parliamentary questions.
Meanwhile, Daniels has stuck to her guns insisting that she was sticking to her claims. “I stand by my testimony. I have noted all the claims that have come weeks later after I gave my testimony.” “We went into one of those apartments. As we walked into the lounge area there were four people, of which I was introduced to Ajay Gupta, Duduzane Zuma, Deputy Minister [of Public Enterprises] Ben Martins and a Chinese lady whose name I could not remember,” she said. “The purpose of the discussion was around the process of the [former Eskom CEO Brian] Molefe court proceedings. Mr Gupta wanted to know how far they were.”
