Judicial Capture Is Not A Myth in SA

South Africa is indeed encountering a capture of constitutional justice to its very core.

Earlier this March, in one of the biased judgments from the South African judiciary, the Judge President of the Gauteng Division of the High Court Dunstan Mlambo rejected a determined bid by Gupta-owned Sahara Computers to have the former Finance Minister Pravin Gordhan personally pay legal costs in the court wrangle involving South Africa’s major banks regarding the Oakbay Investments accounts closure.

Such a similar case scenario has yet again happened yesterday with the same Judge Dunstan Mlambo ruling that President Jacob Zuma should not be authorized to challenge the recommendation of Thuli Madonsela’s State Capture report and that he should personally pay his legal costs. This is a clear case of the South African judiciary being captured by the white monopoly capital.

Judge Mlambo, earlier this month, had given another factional judgment regarding the disposal of NDPP Shaun Abrahams and that Cyril Ramaphosa should pick his replacement – an unprecedented judgement with negligible importance in the constitutional law. This biased stance validates the undivided devotion of the judge towards whites’ preferred ANC presidential candidate Cyril Ramaphosa.

In May this year, the Gauteng High court presided by another WMC sellout Judge Bashier Vally had shown its biased stand by ruling that President Zuma has to provide the records of how he reached a decision of firing Pravin Gordhan and Mbesi Jonas within merely five days. They were laid off in March 2017 cabinet reshuffle. Zuma had to personally pay all the legal costs.

In another all-white favored judgment regarding a lawsuit between RET crusader Manyi and Magda Wierzycka held last month, a similar seizure of justice was prominently evident when Magda influenced the judge chair by deliberately bringing in Fiona Dippenaar who comes from the same group of chambers as David Unterhalter, Wierzycka’s counsel. Manyi eventually lost the case and had to pay all the legal costs from his pockets.

The high-profile lawsuit of the bank accounts closure between the Oakbay Investments and the Bank of Baroda is another case judiciary-captured scenario worth mentioning where the WMC stooge Judge Hans Fabricius was roped in to supervise this high-profile case at the last moment, which eventually led in favor of BOB, thus rendering around 7500 native employees of Oakbay jobless. it was pre-emptive master plot under the direct supervision of the former Finance Ministers Pravin Gordhan and Trevor Manuel. Such breach in justice and capture of Judiciary during last few months just prior to the ANC’s presidential elections is no mere coincidence. One thing is loud and clear that if appropriate measures aren’t taken in due time, our nation would wholly go to the white dogs and their black puppies. So it is high-time to take a sensible stance at the forthcoming 54th ANC Conference by throwing out the puppy Cyril Ramaphosa and coronating Dr Nkosazana Dlamini Zuma as the next party president.
